CAN AN OFFICER BE SUED FOR LEAVING A DETAINEE IN AN UNSAFE LOCATION

A young woman is arrested for disturbing the peace.  The arrest took place close to an airport and was generally a safe location.  While detained in police custody, the young lady alternated between being calm and manic.  The police were notified by her parents that she suffered from bipolar disorder, but the officers did not believe the parents. WHO DECIDES WHERE JAMES BROWN IS TO BE BURIED?

Three recent cases present the question of who gets to decide where a person is buried.  After months of arguing, James Brown, “The Godfather of Soul” was finally buried as was Anna Nichole Smith, a/k/a Vickie Lynn Marshall and finally Ricky Holland, who remains in limbo.  Until recently the answer in Michigan was not all that clear.  Michigan has now passed laws that provide who has the right to make funeral arrangements.  The law now provides that the spouse is ...
